Beijing, October 10 (Xinhua) -- The State Administration for Market Regulation announced on October 10 that in order to ensure public health and safety, it has recently drafted the "Food Safety Law of the People's Republic of China (Revised Draft for Comments)" and solicited public opinions.

The main content of the revision includes five aspects: consolidating the main responsibility. Food production and operation enterprises, as well as operators of online food trading platforms, are required to appoint food safety directors and food safety officers in accordance with regulations, clarify job responsibilities, and strengthen training and assessment; Require food production enterprises to establish a food production process control record system; Establish a system for real name registration, inspection, and security checks for postal and express delivery enterprises; Standardize the entrusted production behavior, clarify the qualification conditions of the entrusting party and the entrusted party.

Strengthen supervision in key areas. Establish a special section on "School Food Safety", establish a principal (kindergarten principal) responsibility system, and establish a centralized meal accompaniment system for primary and secondary schools and kindergartens; Establish a dedicated section for "Online Food Business", implement graded filing management, and clarify the responsibilities of various parties such as platforms, live broadcast room operators, and live broadcast marketers; Clearly define the main responsibility of cross-border e-commerce enterprises for the safety of imported food, food additives, and food related products through cross-border e-commerce.

Optimize the food safety management system. Expand the scope of food safety risk monitoring to include food additives and food related products; Include infant and toddler supplementary foods in special food supervision and implement filing management; Standardize food labeling and commercial promotion, strictly prohibit false and misleading information; Strict food inspection management and standardized entrusted inspection behavior.

Strengthen intelligent supervision. Promote the regulatory application of "Internet plus+AI", clarify that food production and operation enterprises should install monitoring equipment in key risk links of food production and operation, and connect real-time monitoring video information to the information system of the market supervision and management department of the local people's government at or above the county level; Granting regulatory authorities non site inspection permissions such as IoT monitoring and video patrols.

Improve the legal liability system. Set differentiated punishment ranges based on the type of violation; Strictly implement the principle of 'punishment to individuals', and impose penalties on those responsible for intentional violations, malicious nature, and serious consequences of illegal behavior; Complete the penalty clauses corresponding to the newly added obligations and increase the cost of illegal activities; Implement a food safety credit management system and enforce cross departmental penalties for dishonesty.

Next, the State Administration for Market Regulation will improve the revised draft based on the feedback from public solicitation of opinions, and accelerate the revision process in accordance with the requirements of the legislative process, providing solid legal guarantees for regulating food production and operation activities, preventing and resolving risks, strengthening regulatory enforcement, and maintaining food safety for the people.
